Terms of Service

These terms cover your use of the Color Kids app and the colorkidsapp.com website. By installing or using Color Kids, you agree to these terms on behalf of yourself and any child whose use you supervise.
1. Who can use the app
Color Kids is designed for children aged 4–10 and is intended to be used with parental supervision. If you are under 18, a parent or legal guardian must agree to these terms on your behalf and supervise your use of the app, particularly the AI features described below.
2. Acceptable use
Don't use the app to:
- Generate, save, share, or print sexual, violent, hateful, or otherwise harmful imagery, or content that targets a real identifiable person.
- Reverse-engineer, decompile, or attempt to bypass the app's content filters or security.
- Use the app for any commercial purpose other than letting kids color (for example, you may not republish AI-generated pages as a paid coloring book).
We may suspend or limit access to features for any user who appears to be violating these terms.
3. AI-generated content
Color Kids includes a feature that uses artificial intelligence (currently OpenAI's image generation API, gpt-image-1-mini) to turn a typed subject into a black-and-white coloring page. You should know:
- Output is generated, not curated. AI output can vary from request to request. Two runs of the same prompt may produce different drawings, and an output may occasionally contain unexpected elements despite our content filters.
- We apply moderation. Every prompt is screened for unsafe content before generation, and outputs that fail validation are blocked. No moderation system is perfect — adult supervision is recommended whenever a child uses the AI feature.
- Originality is not guaranteed. Generative AI models trained on broad public data can occasionally produce images that resemble existing artwork. Don't assume an AI-generated page is free of third-party rights for commercial use.
- You own your prompts; you control your creations. You retain rights to whatever you type. To the extent the law lets a user own AI output, you own the output your child generates from the app, and your child owns whatever they color in.
4. In-app purchases
Color Kids may offer optional in-app purchases (for example, packs of AI generation credits). Purchases are processed by Apple through your Apple ID. All transactions are governed by Apple's terms; we do not see your payment information.
Refunds for in-app purchases are handled by Apple. To request one, use Apple's Report a Problem page.
If a purchase grants a non-consumable item, it remains tied to the Apple ID that purchased it. Consumable items (such as one-time generation credits) are spent as you use them and don't carry warranties of availability beyond what's been delivered.
5. Privacy
Our handling of your information is described in the Privacy Policy, which is incorporated into these terms by reference.
6. Intellectual property
The Color Kids app, the brand, the bundled coloring page artwork, and the website are owned by us. You receive a personal, non-transferable, revocable license to use the app for non-commercial personal use. Nothing in these terms transfers our intellectual property rights to you.
Free printable coloring pages on this website may be downloaded, printed, and shared for personal, non-commercial use. Don't repackage or sell them.
7. Third-party services
Color Kids uses third-party services to function, including OpenAI (for AI generation) and Apple (for distribution and payments). Their terms apply when you use those parts of the app, and we are not responsible for outages, changes, or issues that originate with those third parties.
8. Disclaimers
Color Kids is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We don't guarantee that the app will be uninterrupted, error-free, or that AI generation will always be available.
9. Limitation of liability
To the maximum extent permitted by law, Color Kids and its team are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, even if we have been advised of the possibility of such damages. Our total liability for any claim arising out of or related to the app is limited to the amount you paid us in the twelve months preceding the claim, or $50 USD, whichever is greater.
10. Changes to these terms
We may update these terms over time. Material changes will be reflected by an updated effective date and, where appropriate, an in-app notice. Continued use after a change means you accept the updated terms.
11. Termination
You may stop using the app and delete it at any time. We may suspend or end access for users who violate these terms. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability) will continue to apply.
12. Apple-specific terms
If you obtained the app from the Apple App Store, the following terms also apply, and Apple's Licensed Application End User License Agreement is incorporated by reference. Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. Apple is a third-party beneficiary of these terms and may enforce them against you.
13. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising from these terms or the app will be brought in the state or federal courts located in San Francisco County, California, unless required otherwise by applicable consumer-protection law.
